Personal Foundations at the Intersection of Law and Economics: Mechanisms for Private Capital Management: A Monograph

This monograph presents for the first time a research-based, original approach to the legal relations that arise in the incorporation and subsequent operation of a private foundation. A comparative analysis of regulations aimed at functionally similar foreign entities, including the Anglo-American trust, the international trust model, the Continental fiducie and the German Treuhand, is followed by an analysis of Russian-law asset partitioning models. The author proposes various solutions to the personal foundation's outstanding management and liability issues. The findings of this study can be used either to improve the legal regulation of personal foundations or to adjust the processes by which that regulation is applied. This study also aims to be of help to students and academic researchers of this area of law.
